A RESOLUTION
AUTHORIZING THE SECOND AMENDMENT TO THE CITY OF LAKEWOOD CITY MANAGER'S EMPLOYMENT AGREEMENT
WHEREAS, effective April 1, 2000, the City of Lakewood adopted the City Manager Defined Benefit Pension Plan and Trust for the City of Lakewood (the "Plan"); and,
WHEREAS, the Plan was amended by that certain First Amendment, dated July 23, 2001, and by that certain Second Amendment, dated December 10, 2002; and,
WHEREAS, the City of Lakewood now desires to amend the Plan to incorporate tax law changes from the Pension Protection Act of 2006 ("PPA"); and,
WHEREAS, the City of Lakewood desires to amend the City Manager's employment agreement to reflect the changes in the City Manager's Defined Benefit Pension Plan and Trust and to make certain clarifications in the employment agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The City Manager's employment agreement is hereby amended to reflect the changes in the City Manager's Defined Benefit Pension Plan and Trust and to make certain clarifications in the employment agreement. Said amendment shall consist of those amendments set forth in the attached Exhibit A, the Second Amendment to Employment Agreement.
INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on January 14, 2008, at 7 o'clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
