A RESOLUTION

APPROVING METRO WASTEWATER RECLAMATION DISTRICT SERVICE TO APPROXIMATELY 148 ACRES OF LAND NEAR C-470 AND ALAMEDA

WHEREAS, owners of approximately 148 acres of land (the "Property') in unincorporated Jefferson County have requested that the City authorize discharge of wastewater from the Property to the Metro Wastewater Reclamation District ("Metro"); and

WHEREAS, the City of Lakewood is a member municipality of Metro; and

WHEREAS, pursuant to section 303 of the service contract between Lakewood and Metro, the Lakewood City Council may approve discharge of wastewater to Metro's facilities from areas outside of the corporate limits of the City; and

WHEREAS, Consolidated Mutual Water Company ("Consolidated") is the likely source of water for the Property; and

WHEREAS, for water rights purposes it is necessary that flows from Consolidated be treated by Metro.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:

SECTION 1. The City Council hereby finds that a portion of the Rooney Valley, which is illustrated on Sheet Number 1 and fully defined in legal descriptions attached hereto and made a part hereof, should be within the service area of the Metro Wastewater Reclamation District.

SECTION 2. The City Manager is directed to file with the Metro Wastewater Reclamation District a certified copy of this resolution and request that the portion of the Rooney Valley, which is defined in the attached documents, be included within the Metro Wastewater Reclamation District service area.

INTRODUCED, READ AND ADOPTED by a vote of 11 For and 0 Against at a regular meting of the City Council on January 14, 2008, at 7 o'clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
