AN ORDINANCE

AUTHORIZING CONVEYANCE OF A NON-EXCLUSIVE EASEMENT TO PUBLIC SERVICE COMPANY OF COLORADO FOR UTILITIES ACROSS PROPERTY OWNED BY THE CITY, LOCATED WITHIN TRACTS K & L, SOLTERRA SUBDIVISION FILING NO. 2

WHEREAS, Public Service Company of Colorado has requested that the City of Lakewood convey to said Company a non-exclusive easement across City owned land for utilities; and

WHEREAS, said land was conveyed to the City by Carma Lakewood, LLC for park or open space purposes; and

WHEREAS, Section 14.3 of the Charter of the City of Lakewood provides that easements may be granted across park land, and the City Council desires to do so in this instance.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest an easement, in form approved by the City Attorney, to Public Service Company of Colorado across land described in Exhibit "A" attached hereto and made a part thereof, for utilities.

SECTION 2. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 8th day of December 2008; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org., on the 11th day of December 2008; set for public hearing on the 12th day of January 2009; read, finally passed and adopted by the City Council on the 12th day of January, 2009, and signed, and approved by the Mayor on the 13th day of January 2009.
