ORDINANCE: O-2008-28
SUBJECT: Ordinance authorizing conveyance of two easements to the Fossil Ridge Metropolitan District No. 1; one for a sanitary sewer line and one for irrigation lines on the eastern edge of the Solterra development.
LOCATION: Eastern buffer of the Solterra development. The sanitary sewer easement is within the southern portion of Tract H, Solterra Subdivision Filing No. 2. The irrigation easement is over Tracts H, K, J, and L, Solterra Subdivision Filing No. 2.
RECOMMENDATION: Staff recommends approval of this ordinance authorizing conveyance of the easements to the Fossil Ridge Metropolitan District No. 1.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Fossil Ridge Metropolitan District No. 1 has requested two easements for a sanitary sewer and irrigation lines within the eastern buffer of the Solterra development.
The buffer area is the north-south open space and trail corridor that connects Forsberg Iron Spring Park with Coyote Gulch Park. Due to the topography of the site, it was determined that a sanitary sewer connection was needed from S. Isabel Street to the existing main in West Iliff Avenue. This portion of Solterra slopes towards the buffer and, whenever possible, wastewater lines are designed to flow by gravity, as opposed to relying on the mechanical and electrical components of a pump system. The easement requested is 30' wide, which is typical for this type of facility.
Irrigation lines are needed in the eastern buffer to allow Fossil Ridge to fulfill its commitment under the previously approved Maintenance Agreement to maintain the eastern buffer landscaping while the vegetation becomes established. Portions of these irrigation lines will also cross back to District owned tracts and public rights of way that will be perpetually maintained by the District. Since the lines will be used for District owned property, in addition to the City open space and rights of way, an easement will be required. As can be seen on the exhibits, the irrigation lines meander through Tracts H, K, J and L. Describing a meandering easement, with various stubs, that criss-crosses the sanitary sewer and water easements would create a confusing spider web of easements. We are therefore proposing a blanket easement, for irrigation only, over Tracts H, K, J and L.
Both the sanitary sewer and the irrigation lines are underground, presenting
no visual or physical encumbrance to the citizens who will be enjoying the open
space corridor.
The buffer was conveyed to the City for "open space or park purposes",
as part of Solterra Subdivision, Filing No. 2, which was approved in July of
2007. The lot and street layout for the adjacent area (which finalized utility
locations within this eastern buffer) were not approved until April of 2008.
These types of utility easements are typically created as a routine part of
the subdivision process. In this case, the City desired to establish ownership
of the eastern buffer with the initial vesting of property rights, thus necessitating
the creation of these easements by Council ordinance.
