ORDINANCE: O-2008-26
SUBJECT: Rezoning Case Number RZ-07-003
To rezone the properties 10075 West Morrison Road and 10109 West Morrison Road
from R-1A (Residential One Acre District) to PD (Planned Development District)
for an office use and office building.
ADDRESS: 10075 and 10109 West Morrison Road
APPLICANT: Glen Gidley, representing property owners Max Prescott, and Robert and Sharon Campbell.
RECOMMENDATION: Staff recommends approval of this rezoning request. The Planning Commission by a vote of 7 to 0 at the July 16, 2008 meeting recommended approval of this request to City Council.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant, Glen Gidley, representing the owners of the two properties, is proposing to rezone the properties from the existing Residential One Acre (R-1A) to Planned Development (PD). The proposed Official Development Plan (ODP) allows for office uses only. The PD zone district was proposed instead of the Office (OF) district to allow the applicant to tailor the ODP so the development standards were more contextual to the surrounding properties. The applicant plans to construct a 3-story office building.
At the July 16, 2008 Planning Commission hearing, the Planning Commission recommended approval of this case by City Council with two additional conditions to the three original conditions presented in the staff report. The staff report included the three conditions:
1. Recordation of the signed Bear Creek Terrace Offices Official Development
Plan and collection of its associated recording fees.
2. Recordation of the Public Improvements Agreement and collection of its associated
fees.
3. Minor modifications to the ODP administrative in nature prior to the recordation
of the ODP.
The two additional conditions added by the Planning Commission at the hearing
are:
4. To accept the changes presented by the applicant at the hearing on Sheet One of the ODP that added text about interior lighting regulations for the building during unoccupied periods.
5. Consolidation of the two lots on the property into one lot via the City of Lakewood process. The applicant must submit an application to the City to begin the subdivision process prior to scheduling a public hearing at Lakewood City Council and must complete the subdivision process prior to recordation of the Official Development Plan
The application to begin the subdivision process was submitted on August 20, 2008. The changes presented by the applicant to Sheet One of the ODP during the Planning Commission hearing are reflected in the ODP that is attached to the Staff Report.
