SUBJECT: Rezoning Case Number RZ-07-005
To rezone the property at 8990 and 8992 West Colfax Avenue from the existing Neighborhood Commercial District (2-C) to Planned Development (PD) to allow for mixed-use development including animal care training, an outdoor exercise area and overnight boarding of animals.

RECOMMENDATION: Staff recommends approval of this rezoning request. The Planning Commission by a vote of 6 to 0 at the April 16, 2008 meeting recommended approval of this request to City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant, Kari Shohet, is proposing to rezone from the existing Neighborhood Commercial District (2-C) to Planned Development (PD). The proposed Official Development Plan (ODP) allows for animal daycare with overnight boarding, an outdoor exercise area, and allows for multi-family residential and those uses allowed within the 2-C zone district. The applicant plans to renovate the site and offer animal day care and training facility.

At the April 16, 2008 Planning Commission meeting, the Planning Commission recommended approval of this case by City Council with several modifications to the Official Development Plan (ODP). Recommended modifications to the ODP include the following:

- Animal drop-off and pick-up hours for the animal care and training facility are limited to the hours of 7:00 a.m. to 7:00 p.m.
- That in the Intent of the ODP we include the term "Dog Care Training Facility and Boarding Facility."
- The overnight boarding of animals is limited to a maximum number of 50 animal runs and a total number of 100 dogs that may .be boarded.overnight at any one time.
- Requirement of one staff member per 12 dogs.
- Adhere to the American Boarding and Kennel Association Accreditation Sanitation and Cleanliness Standards and Procedures.
- To adhere to city building and code standards
- To make corrections to the ODP with the above recommendations

Since the April 16, 2008 Planning Commission meeting, staff has been coordinating with the applicant and property owner to incorporate the development standards required by the Planning Commission into the Official Development Plan. Additionally the applicant held an Open House on June 10, 2008, at the proposed dog day care site to allow residents of the apartment complex an opportunity to see the layout of the facility and how the site would function as a dog day care. One resident attended the open house and voiced concerns about noise. The applicant explained that the dogs would be housed inside the facility overnight and that improvements to the facility would include some sound proofing.
