RFCA O-2008-17 REQUEST FOR COUNCIL ACTION

ORDINANCE: 2008-17

SUBJECT: Ordinance vacating a sanitary sewer easement between Garrison Street and Independence Street just north of West 9th Avenue.

ADDRESS: Between Garrison Street and Independence North of West 9th Avenue.

RECOMMENDATION: Staff recommends approval of this vacation.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: Back in April 2006 the City completed a storm drainage improvement project to stabilize the banks in Lakewood Gulch as it runs between Independence Street and Garrison Street. As a result of this project, the City removed a sanitary sewer line that had been abandoned by South Lakewood Sanitation District. The City of Lakewood is the successor of this District. It was also agreed by City staff, as a result of this improvement project, to process a request to City Council requesting the easement be vacated. Because the sanitary sewer line was removed, the easement that was conveyed to South Lakewood Sanitation District is no longer needed and should be vacated. Vacating this easement removes the easement restriction from the chain of title on the properties that were affected by this easement. City staff is requesting this vacation on behalf of the affected property owners and have no concerns.
