ORDINANCE: 2008-16
SUBJECT: Ordinance vacating a sanitary sewer easement across the Lakewood High School property at 9700 West 8th Avenue.
ADDRESS: 9700 West 8th Avenue.
RECOMMENDATION: Staff recommends approval of this vacation.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: Jefferson County R-1 School District did some remodeling to the High School. As a result of the remodeling they had to relocate the existing sanitary sewer line to a new location which also required the School District to convey a new easement to the City, which the School District has already done. It was also agreed by City staff to process a request to City Council requesting the old easement be vacated. Because the old sanitary sewer line was removed, the previous easement that was conveyed to the City is no longer needed and should be vacated. Vacating this easement removes the restriction for this easement from the chain of title on the property. City staff is requesting this vacation on behalf of the School District and have no concerns.
