RFCA-O-2008-2 REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2008-2

SUBJECT: Authorizing the renovation of the Carmody Recreation Center aquatics facility including a Supplemental Appropriation to the 2008 Annual Budget and waivers from various sections of the Purchasing Ordinance as needed by this project. The necessity of expediting this project is based on the effects a delay has on pricing, contractor availability, timing of completion, and unavailability of the swimming pools until such time as they are renovated.

RECOMMENDATION: Adoption of the Supplemental Appropriation to the 2008 Annual Budget in the amount of $2,200,000 and approval of the transfer of the funds from the General Fund to the Capital Improvement Fund, and approval of the waivers of certain provisions of the Purchasing Ordinance for the renovation of the Carmody Pools.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Carmody Recreation Center aquatics facility consists of a 50-meter indoor pool and a 25-yard outdoor pool. The pools share plumbing and drainage systems. Both swimming pools are currently used for swimming instruction, USA swim team training and competition, USA diving team training and competition, high school swim team training and competition, high school dive team training and competition, master's swimming, fitness classes, fitness lap swimming, recreational swimming and recreational diving.

Staff has observed that it was becoming increasingly difficult to regulate both the water level and temperature at the indoor pool. Due to the age of the water supply and waste piping systems for both pools, the entire pool drainage infrastructure required analysis. The indoor and outdoor pools were constructed in 1974 and all piping (supply and waste) is original. The system is outdated, and does not comply with current industry standards.

Underwater investigation and testing confirmed that the pool water supply lines were beginning to fail and leak into the sub-drain system underpan. The swimming pool consulting engineering firm of Counsilman-Hunsaker was contracted to perform an assessment of the overall condition of the indoor and outdoor pools, which included a review of the drainage failure problem of the indoor pool.

Due to the continued increase in the volume of water loss, the management staff operating this swimming pool was unable to maintain a suitable water temperature for users. It became necessary to drain and close the indoor pool until major repairs could be completed.
Counsilman-Hunsaker has been contracted to complete design and engineering services for repair and refurbishment of the Carmody indoor and outdoor pools. The design and engineering services provided by Counsilman-Hunsaker will address the indoor pool problem as well as other required improvements to the indoor and outdoor pools. The renovation and repair work completed will include but not be limited to the following:

• Install stainless steel gutter system
• Replace main drain sump pump equipment
• Replace pressure piping
• Replace surge tanks
• Provide emergency shut down controls
• Replace chemical controllers and flow assembly
• Provide hydrant box for handicap lift
• Replace mechanical room equipment, pumps, motors, high rate sand filters, flow meters, valves, piping, and gauges
• Replace backwash pit
• Provide automatic water level controllers
• Repair pool shell, and apply new finish

Legal Justification: Article XII section 8 of the Lakewood Home Rule Charter allows the City Council to make supplemental appropriations by ordinance during the fiscal year for unanticipated expenditures. Budget Policy Resolution 2005-48 states "If special circumstances warrant the use of General Fund reserves, the City Manager will submit a memorandum to City Council outlining those special circumstances, the amount requested, the impact on City services, and alternatives to the use of General Fund reserves." This Request for Council Action is in lieu of the City Manager's memorandum. In addition, the City's Purchasing Policies within the Lakewood Municipal Code require that City Council approve unbudgeted expenditures over $50,000 and for any capital improvement construction over $500,000.
