SUBJECT: Intergovernmental Agreement (IGA) with the Regional Transportation District (RTD) for Betterments for the Oak Street Light Rail Station.
Recommendation
The Department of Community Planning and Development recommends Council approval to enter into an Intergovernmental Agreement (IGA) between the City of Lakewood and The Regional Transportation District (RTD) for the purpose of the design and construction of certain elements of the Oak Street Light Rail Station.
Background
The City of Lakewood is working with RTD to develop an alternate design for the Oak Street Station Plaza. Lakewood is interested in developing a station plaza design that is more unique and identifiable to Lakewood than RTD's design. A more unique design would become a focal point and an asset for future development around the station as delineated in the adopted Oak Street Station Area Plan and Lakewood Transit Mixed- Use Zoning (TMU). The current RTD design includes only what RTD identifies as the 'transition plaza,' the area between the train station and the roadway. RTD's design is their 'Inter-urban' style. RTD has included this Inter-urban design in their 90% project design package.
Alternate Transition Plaza Design
The City of Lakewood has devoted considerable resources in developing the Oak
Street Station Area Plan and Transit Mixed-Use (TMU) zoning for the Oak Street
Station Area. A long-term vision has been developed along with the zoning tools
to implement this vision. A high quality and functional Oak Street Station design
will contribute to the redevelopment potential. Lakewood is developing an alternate
design of the station plaza. The purpose of the alternate design is to provide
a higher quality station design that will facilitate long-term Transit Oriented
Development at the Oak Street Station. This alternate design was also included
as part of the 90% project design package. The alternate design includes a layout
of the plaza, benches, lighting, overhead shelters, and landscaping. The cost
difference between the alternate design and RTD's design has preliminarily been
estimated to be an additional $135,000. This $135,000 will need to be included
in Lakewood's 2009 budget. The final cost estimate by RTD's Construction Manager/General
Contractor (CM/GC) contractor will refine this number when they complete their
guaranteed Maximum Price (GMP) from the 90% drawings. RTD will continue to be
responsible for maintenance of this facility.
Fence at Gambro Property
An additional component of this alternate design is the fence that borders the
Oak Street Station and Gambro property. RTD's design is a standard RTD fence
at the station and the chain link fence outside of the station. Gambro and Lakewood
desire a higher quality treatment. Lakewood's alternate design has been accepted
by RTD.
Intergovernmental Agreement
Both the transition plaza design and the Gambro fence design are addressed in
the Intergovernmental Agreement (IGA). The Oak Street Station Intergovernmental
Agreement will address design issues, maintenance, and financing beyond RTD's
standard design. RTD would continue to be responsible for maintenance of all
constructed facilities at the Oak Street Station. The IGA is being structured
very similar to the Intergovernmental Agreement that was adopted for the RTD
West Corridor Wadsworth Station. The Intergovernmental Agreement has been and
will be reviewed and approved, by both Lakewood's and RTD's legal staff.
