RESOLUTION: 2007-60
SUBJECT: Carma Lakewood, LLC, has tendered to the City of Lakewood an executed Warranty Deed for conveyance of two tracts of land along Coyote Gulch intended as a buffer between the Solterra development and existing homes to the East. The conveyance was tied to the approval by City Council of vested rights to develop the project.
ADDRESS: South Indiana Street and West Illiff Avenue
RECOMMENDATION: Adoption of this resolution accepting the conveyance of the vacant land to the City of Lakewood.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: When Carma Lakewood, LLC ("Carma"), presented the development plan for the Springfield Green area (AKA Rooney Valley) to the City of Lakewood, the neighborhood requested, as part of the activities related to this development, the City attempt to obtain title to vacant land along Coyote Gulch as a buffer between the new development and the existing neighborhood. Carma agreed and did so in part by dedicating a 50-foot buffer but made the conveyance of additional lands conditional on Vested Rights being granted by City Council which was granted by Ordinance O-2007-26. The City is now asking that these additional lands be conveyed as result of the granted Vested Rights to which Carma has agreed. Carma has executed the necessary Warranty Deed; this vacant land contains 2.6136 acres, and is shown on the attached map as Tracts H and J.
