RESOLUTION: 2007-33
SUBJECT: Awarding a contract to reconstruct five traffic signals and amending an intergovernmental agreement with the Colorado Department of Transportation (CDOT)
RECOMMENDATION: Approval

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
On April 5, 2007, the City opened bids for the Lakewood Traffic Signal Project, Bid No. 2642. The lowest responsible, responsive and qualified bidder was Technology Constructors, Incorporated with a bid of $1,608,289.00. The project will improve safety by rebuilding the traffic signals at Kipling/Florida, Wadsworth/5th Avenue, Wadsworth/Morrison, Garrison/Alameda and Kipling/Colfax.
The bid amount exceeds the project budget but is deemed a competitive bid in the current environment of rising construction costs. CDOT has agreed to provide additional federal funds to complete the project. The contractor has agreed to a phased contract award as funds become available. The initial construction contract would be $1,437,509.00, which is within the current budget.
In addition to authorizing the construction contract, the attached resolution would authorize an amendment to the Intergovernmental Agreement between Lakewood and CDOT to provide the needed additional federal funds of $216,774.00. A separate supplemental budget appropriation ordinance will be on the City Council May 14, 2007 and June 11, 2007 agendas. After the ordinance is adopted and the amendment is executed with CDOT, a change order will be issued to the construction contractor to increase the contract to the bid amount. Authorization is also included in the attached resolution for up to $35,000.00 as a contingency if needed for unanticipated construction items for a total contract amount not to exceed $1,643,289.00.
The cost of the construction contract will be paid entirely from federal safety funds. Federal safety funds will reimburse Lakewood for the property rights necessary for the project. Necessary property rights have been successfully acquired through negotiation. Some of Lakewood's staff costs for design and construction management will be paid from federal funds.
