A RESOLUTION
ACCEPTING A BID AND AUTHORIZING A CONSTRUCTION CONTRACT TO UPGRADE FIVE LAKEWOOD TRAFFIC SIGNALS AND AUTHORIZING AN AMENDMENT TO AN INTERGOVERNMENTAL AGREEMENT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION
WHEREAS, by invitation to bid No. 2642, the City of Lakewood advertised for bids for the Lakewood Traffic Signal Project and bids were opened on April 5, 2007; and
WHEREAS, the lowest responsive, responsible and qualified bidder has been determined to be Technology Constructors, Incorporated, which has submitted its bid in the amount of One Million Six Hundred Eight Thousand Two Hundred Eighty-nine and 00/100 Dollars ($1,608,289.00) pursuant to City specifications and instructions and the City desires to accept the bid of said bidder; and
WHEREAS, Resolution 2005-32 authorized the City of Lakewood to enter into an Intergovernmental Agreement with the Colorado Department of Transportation (CDOT) to use federal safety funds to improve five traffic signals in Lakewood; and
WHEREAS, Lakewood and CDOT desire to amend the Intergovernmental Agreement to add $216,774.00 of federal safety funds; and
WHEREAS, Technology Constructors, Incorporated is willing to accept a phased contract to match funding availability.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:
SECTION 1. The bid of Technology Constructors, Incorporated for the Traffic Signal Project at five locations as described in Invitation to Bid No. 2642 is hereby accepted in the amount of $1,608,289.00 according to the specifications as defined in the Invitation to Bid.
SECTION 2. The City Manager is hereby authorized to execute and the City Clerk attest a contract with said bidder in form approved by the City Attorney in the amount of One Million Four Hundred Thirty-seven Thousand Five Hundred Nine and 00/100 Dollars ($1,437,509.00). The City Treasurer is hereby authorized to make payment to Technology Constructors, Incorporated in accordance with the terms of said contract.
SECTION 3. The City Manager is hereby authorized to enter into an Intergovernmental
Agreement amendment with CDOT for an additional $216,774.00 of federal safety
funds to be used for the Traffic Signal Project.
SECTION 4. Upon approval of a supplemental budget appropriation ordinance and
execution of the Intergovernmental Agreement amendment with CDOT, the City Manager
is further authorized to execute change orders up to One Hundred Seventy Thousand
Seven Hundred Eighty and 00/100 Dollars ($170,780.00) to increase the contract
amount to the bid amount.
SECTION 5. The City Manager is further authorized to execute change orders for unanticipated construction items, if necessary, up to Thirty-five Thousand and 00/100 Dollars ($35,000.00) for a total contract amount not to exceed One Million Six Hundred Forty-three Thousand Two Hundred Eighty-nine and 00/100 Dollars ($1,643,289.00).
INTRODUCED, READ AND ADOPTED by a vote of 10 For and 0 Against at a regular meeting of the City Council on May 14, 2007, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
