A RESOLUTION
AMENDING AN INTERGOVERNMENTAL AGREEMENT WITH THE METRO WASTEWATER RECLAMATION DISTRICT TO DELEGATE ADDITIONAL PRETREATMENT AND INDUSTRIAL WASTE CONTROL PROGRAM RESPONSIBILITIES FROM LAKEWOOD TO THE METRO WASTEWATER RECLAMATION DISTRICT
WHEREAS, in 1994 Lakewood entered into an Intergovernmental Agreement with the Metro Wastewater Reclamation District (Metro) to delegate a significant portion of pretreatment and industrial waste control program responsibilities to Metro; and
WHEREAS, in 2004 Lakewood and Metro amended the Intergovernmental Agreement to transfer to Metro the additional responsibility of reporting functions related to pretreatment and industrial waste control; and
WHEREAS, West Alameda Heights Sanitation Services, Inc. (West Alameda Heights) contributes sewer flows to Lakewood's sanitary sewer utility; and
WHEREAS, West Alameda Heights does not have the authority to enforce a pretreatment and industrial waste control program; and
WHEREAS, enforcement of a pretreatment and industrial waste control program in the area served West Alameda Heights is the responsibility of Lakewood; and
WHEREAS, Lakewood, Metro and West Alameda Heights desire that Metro assume functions related to pretreatment and industrial waste control in the area served by West Alameda Heights; and
WHEREAS, Metro will provide the additional pretreatment and industrial waste control functions at no additional cost to Lakewood or to West Alameda Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to amend the intergovernmental
agreement with Metro, in a form approved by the City Attorney, to delegate to
Metro pretreatment and industrial waste control responsibilities for the area
served by West Alameda Heights.
INTRODUCED, READ AND ADOPTED by a vote of 10 For and 0 Against at a regular meeting of the City Council on May 14, 2007, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
