A RESOLUTION

ESTABLISHING FEES FOR VESTING OF PROPERTY RIGHTS APPLICATIONS

WHEREAS, Title 17 of the City of Lakewood Municipal Code directs the City Council to establish, by Resolution, fees for any appeal, process, procedure, or other action relating to the Zoning Ordinance; and

WHEREAS, Title 16 of the City of Lakewood Municipal Code directs the City Council to establish, by Resolution, fees for any appeal process, procedure, or other action relating to the Subdivision Ordinance; and

WHEREAS, City Council amended the Zoning Ordinance on December 11, 2006 to allow for the vesting of property rights through an application heard by the Planning Commission and City Council at a public hearing; and

WHEREAS, the notice requirements for such application require the City of Lakewood to provide public notice for such public hearings in a newspaper of record at a cost for such publication.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The following fees are hereby established for processing a vesting of property rights application and any associated appeal of the termination of that vesting of property rights, effective January 22, 2007.

Vesting of Property Rights: $50.00
Appeal per Section 17-18-5 $100.00

SECTION 2. Upon application to the City Manager, the City Manager may waive or reduce fees established by this resolution if such action will further the economic goals of the City as set forth in Section 3.26.010 of the Lakewood Municipal Code. Such finding shall be made in writing.

SECTION 3. The preceding fees shall not be refunded in whole or in part, unless the application was accepted due to an error on the part of the City staff.

INTRODUCED, READ AND ADOPTED by a vote of 10 for and 0 against at a regular meeting of the City Council on January 22, 2007, at 7 p.m., at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
