ORDINANCE: 2007-29
SUBJECT: Emergency ordinance authorizing the City to convey a non-exclusive easement for electric distribution lines and related appurtenances to Public Service Company across Tract B, DANIELS PLACE SUBDIVISION located on the West side of Nelson Street South of the Regional Transportation District property in the vicinity of West 13th Avenue and Nelson Street.
ADDRESS: North of the intersection of West 13th Avenue and Nelson Street.
RECOMMENDATION: Staff recommends approval of this ordinance authorizing conveyance of the easement to Public Service Company.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: Public Service Company has asked the City for a blanket non-exclusive easement across Tract B, Daniels Place Subdivision, which said Tract B, was conveyed to the City by the plat of Daniels Place Subdivision, as part of the plat's open space requirement. This park has never been developed and there are no future plans to develop this as a park. This non-exclusive easement is necessary to allow Public Service Company to relocate the existing electrical distribution lines and related appurtenances off the RTD property and not relocate these improvements, as first planned, into the existing easements located in the small back yards of the residents, which has come under strong opposition by the residents. The relocation of this distribution line is due to the construction of the light rail system in this area. Staff has reviewed the proposed distribution line and determined that it is in the right location and will not interfere with the future use of the City land.
