SUBJECT: Re-Inclusion of a portion of the Rooney Valley into the Metro Wastewater Reclamation District service area.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The City of Lakewood is under contract with the Metro Wastewater Reclamation District to send all sewage flows from within the Lakewood city limits to Metro Wastewater unless an exclusion is granted.

In late 2002, it appeared the only two possible water suppliers in the Rooney Valley would be the Town of Morrison and the Mt. Carbon Metropolitan District. Water Court decrees require that sewer flows resulting from use of Morrison and Mt. Carbon water flow to Bear Creek through the Morrison Wastewater Treatment Plant.

In order to send flows from Lakewood to the Morrison Wastewater Treatment Plant, it was necessary under state law for Lakewood to request an exclusion from Metro Wastewater by ordinance and this was done by Ordinance O-2002-49. Such an exclusion was subsequently granted by Metro Wastewater for all Rooney Valley property within Lakewood.

Several conditions have changed since 2002. These changed conditions necessitate re-including most of the Lakewood portion of the Rooney Valley back within the Metro Wastewater Reclamation District service area. These changed conditions are:

• The water supplier for the Lakewood portion of the Rooney Valley will be the Consolidated Mutual Water Company. After use, Consolidated's water flows are to be treated at Metro Wastewater for water rights purposes.

• Many properties in Lakewood have recently been excluded from the Mt. Carbon District.

By ordinance O-2006-26, City Council approved re-inclusion of several Rooney Valley properties, totaling approximately 801 acres, into the Metro Wastewater Reclamation District. An additional property is now to be re-included. The property to be re-included within the Metro Wastewater Reclamation District was recently excluded from the Mt. Carbon District and is approximately 26 acres.
The only areas in the Lakewood portion of the Rooney Valley not to be re-included in Metro Wastewater are 1) five small parcels within Red Rocks Business Park Filing No. 1 whose owners chose not to exclude from Mt. Carbon, 2) Robinson Brick, also still in the Mt. Carbon District and 3) the site owned by Mt. Carbon for its water tank.

As with the exclusion, the inclusion is to be done by ordinance.
