ORDINANCE: O-2007-26
SUBJECT: Vesting Case Number VS-07-003
To establish a vested property right for the Solterra Subdivision Filing No.
2 by approving an associated development agreement allowing for a period of
25 years in order to permit implementation of the Solterra development.

RECOMMENDATION: Staff recommends approval of this vesting request. The Planning Commission by a vote of 6 to 1 at the July 18, 2007 meeting recommended approval of this request to City Council.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant, Chris Bremner, Carma Lakewood, LLC, is requesting to establish a vested property right for the Solterra Subdivision Filing No. 2 by approving an associated development agreement for a period of 25 years in order to implement the development of the master planned community, Solterra, as allowed in the previously approved Springfield Green ODP, Springfield Green ODP Modification No. 1 & 2 in order to construct a maximum of 1,489 units on approximately 298.08 acres, the Westwind ODP that allows for single-family, multi-family and commercial uses; and the Area A of the Lakewood West ODP that allows for residential uses. The applicant is requesting vesting for a period of 25-years in order to complete the various phases of the Solterra development due to the size of the project and length of time to process applications and construct the development, and market & economic conditions.
At the July 18, 2007 Planning Commission meeting, the Planning Commission recommended approval of this case by City Council. The case is now ready for City Council action.
