ORDINANCE: O-2007-17
SUBJECT: Legislative Re-Mapping/Rezoning PL-07-004
Rezoning parcels of land located within the Sheridan Boulevard Station Area
Plan, the Wadsworth Boulevard Station are plan, the Oak Street Station Area
Plan, and the Union Boulevard Corridor Area Plan, as adopted as part of the
City's Comprehensive Plan through a legislative rezoning of the current zone
district classifications to the Transit Mixed Use (TMU) Zone District.

RECOMMENDATION: The Planning Commission, by a vote of 7 to 0 at the May 2, 2007 meeting, recommended approval of Case Number PL-07-004. Staff also recommends approval of Case Number PL-07-004.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood has initiated the legislative re-mapping (rezoning) process to allow for redevelopment in those areas that will surround the major light rail stations in the City that include parking facilities.
The City is providing flexibility, and accommodating private investment and economic activity in areas that will be experiencing development pressure, which has occurred in similar situations in the Denver metropolitan area and across the United States. This effort will allow for regulated and appropriately designed growth within the station areas. At the same time, the City will be limiting the impacts of this activity on the neighborhoods located outside of the re-mapping (rezoning) boundaries by providing stability to the surrounding residential and commercial properties.
In August of 2006, the City Council amended Section 17-17-8 of the Zoning Ordinance to allow for the legislative re-mapping (rezoning) process to occur. A legislative re-mapping (rezoning) can be initiated by the City, rather than by an individual property owner.
A legislative re-mapping (rezoning) is distinguished from a routine quasi-judicial rezoning, per Section 17-17-8, by the following:
a) the rezoning affects a large number of properties and the proposed rezoning is not applicable only to a specific individual or readily identifiable group of individuals;
b) it would be inefficient, cumbersome, and unduly burdensome on the resources of the City to rezone the potentially affected properties on a site-by-site basis; and
c) the rezoning is prospective in nature and reflects public policy of a permanent or general character impacting the City on a scale greater than at the individual property level.
The proposed TMU legislative re-mapping (rezoning) action would encompass over 800 properties making it inefficient, cumbersome, and unduly burdensome to rezone the affected properties in a quasi-judicial manner. The proposed legislative re-mapping (rezoning) reflects public policy on a scale greater than an individual property, as the construction and opening of the West Corridor light rail line will have a City-wide and region-wide impact.
Additionally, the proposed legislative re-mapping (rezoning) would implement the specific goals and objectives of the adopted Station Area Plans, which are part of the City's Comprehensive Plan. The proposed legislative re-mapping (rezoning) promotes the health, safety and welfare of City residents, and public interest, by allowing for orderly, controlled development.
Station Area Plans for the four areas that are the subject of the re-mapping (rezoning) request were adopted by the City as Comprehensive Plan amendments in November of 2006. Article 22 of the Zoning Ordinance, the Transit Mixed Use Zone District, was approved by the City Council in February of 2007.
