AN ORDINANCE

APPROVING A SUPPLEMENTAL BUDGET APPROPRIATION IN THE GRANT FUND FOR TRAFFIC SIGNAL UPGRADE WORK; FURTHER DECLARING AN EMERGENCY

WHEREAS, Resolution 2005-32 authorized the City of Lakewood to enter into an Intergovernmental Agreement with the Colorado Department of Transportation (CDOT) to use $1,680,000 in federal safety funds to improve five traffic signals in Lakewood; and

WHEREAS, On April 5, 2007 the City opened bids for the Lakewood Traffic Signal Project, Bid No. 2642. The lowest responsible, responsive and qualified bidder was Technology Constructors, Incorporated with a bid of $1,608,289; and

WHEREAS, The bid amount exceeds the project budget but is deemed a competitive bid in the current environment of rising construction costs and CDOT has agreed to provide additional federal funds to complete the project; and

WHEREAS, Lakewood and CDOT desire to increase the amount of federal safety funds by $216,774 to cover additional project costs; and

WHEREAS, pursuant to the Lakewood Home Rule Charter, Section 12.8, the City Council may make supplemental appropriations by ordinance during the fiscal year.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. In accordance with Section 12.8 of the Lakewood Home Rule Charter, a supplemental budget appropriation is hereby authorized in the Grant Fund, whereby the Lakewood Traffic Signal Project budget will be increased for fiscal year 2007 by $216,774 utilizing federal safety funding.

SECTION 2. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety. The immediate approval of the ordinance is necessary to allow the traffic signal work to be completed during the 2007 construction season.

SECTION 3. This ordinance shall take effect upon the Mayor's signature.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 14th day of May, 2007; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org, on the 17th day of May, 2007; set for public hearing on the 11th day of June, 2007, read, finally passed and adopted by the City Council on the 11th day of June, 2007, and, signed and approved by the Mayor on the 12th day of June, 2007.
