ORDINANCE: O-2007-11
SUBJECT: Declaring the intent of the City of Lakewood to acquire interests in property for public purposes for the construction of curb, gutter and sidewalk improvements on the west side of Union Boulevard between West 6th Avenue and West 4th Avenue for the Union Boulevard \ West 4th Avenue Improvements Project, authorizing negotiations with property owners, acceptance of conveyance instruments, and condemnation of real property interests 445 Union Boulevard, further declaring an emergency.

RECOMMENDATION: Staff recommends approval of this ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The City has been negotiating since January 26, 2007, to acquire needed property
interests from the property at 445 Union Boulevard. This project is to improve
traffic circulation from West 6th Avenue to West 4th Avenue by adding a through
right turn lane along Union Boulevard from West 6th Avenue South to West 4th
Avenue. This project will also include relocating a portion of the existing
sidewalk on the West side of Union Boulevard to accommodate this additional
lane.
A purchase agreement has not yet been reached with the owners at the above mentioned address. The City must act now to exercise its right of eminent domain to acquire these property interests and maintain the project schedule. It is anticipated the owner will reach agreement with the City for the rights-of-way required without the need to actually file condemnation actions. In the event that condemnation is required, this ordinance will preserve the construction schedule. The ordinance has the emergency clause to allow the project to remain on schedule and the completion of this project during the 2007 construction season.
FUNDING SOURCE: This project is being funded by the Transportation Improvement Fund.
