LAKEWOOD LIQUOR AND FERMENTED MALT BEVERAGE
LICENSING AUTHORITY
August 23, 2007

A Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.

ITEM 1 - CALL TO ORDER

Chairwoman Hansson called the meeting to order at 7:00 p.m.

ITEM 3 - APPROVAL OF MINUTES

Regular Meeting July 12, 2007
Regular Meeting July 26, 2007

Mr. Williams made a motion to accept the meeting minutes of July 12, 2007 and July 26, 2007. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.

ITEM 4 - NEW APPLICATION (Continued from July 26, 2007)

Carl Ream, Registration No. 19397, stated he was the attorney representing the applicant.

Kelly Pietrs, 2792 S. Race St., Denver, CO 80210, was sworn in and stated she was the managing member of Esquire Petitioning Services, who did the survey. Ms. Pietrs stated the procedures used to do the petitions and explained the results of the survey.

Sung Wan Kang, 20470 E. Mansfield Ave., Aurora, Co. 80013, was sworn in.

Jay Kahng, was sworn in and stated that he would be the interpreter for Mr. Kang, who's English was very limited. Mr. Kahng stated that he had experience interpreting from Korean into English. Mr. Kahng stated that Mr. Kang said that he was the owner of LaBallerina, Inc. Mr. Kahng stated that Mr. Kang said that he asks his employees to read the Colorado Liquor Codes and he trains his employees to recognize someone who is under the influence of alcohol and the methodology of checking I.D.s. Mr. Kahng stated that Mr. Kang said that he requires his employees to take the TIPS class. Mr. Kahng stated that Mr. Kang said that he had recently taken the TIPS class, himself.

There was a question and answer period between the Liquor Licensing Authority and Mr. Kang with Mr. Kahng interpreting.

Mr. Wisneski moved to approve the application for a Tavern License for LaBallerina, LLC, d/b/a LaBallerina, located at 5660 W. Colfax Ave. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.

ITEM 5 - NEW APPLICATION (Continued from July 26, 2007)

3.2% Off Premises Fermented Malt Beverage License

James Beimford, Registration No. 13142, stated he was the attorney representing the applicant.

There was a question and answer period between the Liquor Licensing Authority and Ms. Pietrs.

Eunja Chang, 9943 Heywood Street, Highlands Ranch, CO 80130, was sworn in and stated she was the owner of T & A Conoco, LLC. Ms. Chang stated that she does not have any experience selling alcohol but plans to attend the Lakewood Alcohol Awareness Class prior to selling alcohol. Ms. Chang stated that many of her customers have made requests to buy beer at her store, especially on Sundays.

There was a question and answer period between the Liquor Licensing Authority and Ms. Chang.

Mr. Muniz moved to approve the application for a 3.2% Off Premises Fermented Malt Beverage License for T & A Conoco, LLC d/b/a T & A Conoco, located at 99 Wadsworth Blvd. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.

ITEM 6 - NEW APPLICATION

Hotel & Restaurant License
GMRI, Inc.
d/b/a Red Lobster
810 S. Wadsworth Blvd.

Alan Dill, Registration No. 872, stated that he was the attorney representing the applicant.

Max Scott, 1216 Tiperary St., Boulder, CO 80306, was sworn in and stated he was the managing member of Oedipus, Inc., who did the survey. Mr. Scott stated the procedures used to do the petitions and explained the results of the survey.

There was a question and answer period between the Liquor Licensing Authority and Mr. Scott.

Mr. Dill stated that the Red Lobster on Union Blvd. would be closing once the Red Lobster on 810 S. Wadsworth Blvd. was ready to open. Mr. Dill stated that they did not file a change in location rather than a new application because they were not sure of the timing. Mr. Dill stated that the State regulations require that a liquor licensee must move to the new location within 90 days of the approval of the change.

Mary Ann Starnes, 6785 W. 52nd Ave., Arvada, CO 80002, was sworn in and stated she would be the General Manager of the new Red Lobster. Ms. Starnes stated her experience with Red Lobster and that she was the current General Manager of the Red Lobster on Union Blvd. Ms. Starnes stated that the new restaurant was scheduled to open in about eight days and that the employees from the old restaurant would transfer to the new location. Ms. Starnes stated there would be four Assistant Managers and there would always be a management person on the floor during business hours. Ms. Starnes stated Red Lobster's training program, policies and procedures regarding the sale of alcohol.

Mr. Muniz moved to approve the application for a Hotel & Restaurant License for GMRI, Inc. d/b/a Red Lobster, located at 810 S. Wadsworth Blvd. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.

ITEM 7 - SHOW CAUSE HEARING

The hearing was continued to October 11, 2007 due to a request for a continuance from the licensee's attorney.

ITEM 8 - SHOW CAUSE HEARING

Riley's, Inc.
d/b/a Riley's
1515 Garland St.

The hearing was continued to October 11, 2007 due to a request from the licensee.

ITEM 8 - GENERAL BUSINESS

Ms. Roth stated she had a complaint being brought forward for a motion for a Show Cause Hearing. The complaint was for Martoo Corp., Inc. d/b/a Sunset Liquor of Lakewood located at 9151 W. Colfax Ave. The complaint was issued for the alleged sale of alcohol to a visibly intoxicated person.

Mr. Wisneski made a motion to serve a Notice of Hearing and Order to Show Cause why the Retail Liquor License held by Martoo Corp., Inc. d/b/a Sunset Liquor of Lakewood, 9151 W. Colfax Ave, should not be suspended or revoked, such hearing to be held on October 11, 2007. The motion was seconded and with all members of the Liquor Licensing Authority present voting aye, THE MOTION CARRIED.

ITEM 9 - ADJOURNMENT

There being no further business to come before the Authority, Chairwoman Hansson adjourned the meeting at 7:52 p.m.
