REGULAR MEETING OF
LAKEWOOD LIQUOR AND FERMENTED MALT BEVERAGE
LICENSING AUTHORITY
February 22, 2007

A Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.

ITEM 1 - CALL TO ORDER

Chairwoman Hansson called the meeting to order at 7:00 p.m.

ITEM 3 - APPROVAL OF MINUTES

Mr. Wisneski made a motion to accept the meeting minutes of July 27, 2006, November 9, 2006, November 16, 2006, December 14, 2006 and January 11, 2007. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.

ITEM 4 - NEW APPLICATION

Hotel & Restaurant License
McGrath's Publick Fish House, Inc.
d/b/a McGrath's Fish House
14035 W. Colfax Dr.

James Marshall, 1218 Park Meadow Dr., N.E., Keizer, Oregon, 97303, was sworn in and stated he is the Vice President and Director of Operations for McGrath's Fish House. Mr. Marshall stated the history and philosophy of the company. Mr. Marshall stated it is a family-friendly and wholesome restaurant. Mr. Marshall stated the policies regarding the service of alcohol and the training process for the employees.

There was a question and answer period between the Liquor Licensing Authority and Mr. Marshall.

Max Scott, 1216 Tiperary St., Boulder, CO 80306, was sworn in and stated his company, Oedipus, Inc., did the survey petitions and explained the results of the survey.

Mr. Muniz moved to approve the application for a Hotel & Restaurant License for McGrath's Publick Fish House, Inc. d/b/a McGrath's Fish House, located at 14035 W. Colfax Dr. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.

ITEM 5 - SHOW CAUSE HEARING

Retail Liquor License
Martoo Corp., Inc.
d/b/a Sunset Liquor of Lakewood
9151 W. Colfax Ave.

Ms. Roth stated that the complaint was filed because the sales tax for Sunset Liquor of Lakewood was outstanding for August, September and October of 2006. Ms. Roth stated that as of yesterday, Sunset Liquor of Lakewood is in compliance for those months. Ms. Roth stated that the December and January tax returns are currently outstanding. Ms. Roth stated she had talked to the licensee about continuing the hearing to the next available date and if he was in compliance by the next meeting, the City would move to dismiss the complaint. Ms. Roth asked to continue the hearing until the next available date.

Mr. Wisneski moved that the Show Cause Hearing for the Retail Liquor License of Martoo Corp., Inc. d/b/a Sunset Liquor of Lakewood be continued to March 22, 2007. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.

ITEM 6 - GENERAL BUSINESS

Ms. Roth stated there were three complaints being brought forward for motions to show cause as a result of a compliance check performed by the Lakewood Police Department on December 19, 2006.

The first complaint was for Kyong Hui Springer d/b/a Curve Liquors, 6795 W. Mississippi Ave. for alleged sale to a minor.

Mr. Muniz made a motion to serve a notice of hearing and order to show cause why the Retail Liquor License held by Kyong Hui Springer d/b/a Curve Liquors, 6795 W. Mississippi Ave, should not be suspended or revoked, such hearing to be held on March 22, 2007. The motion was seconded and with all members of the Liquor Licensing Authority present voting aye, THE MOTION CARRIED.

The second complaint was for Tibeck, Inc. d/b/a Front Range Inn, 7779 W. Morrison Road for alleged sale to a minor.

Mr. Muniz made a motion to serve a notice of hearing and order to show cause why the Tavern License held by Tibeck, Inc. d/b/a Front Range Inn, 7779 W. Morrison Road, should not be suspended or revoked, such hearing to be held on March 22, 2007. The motion was seconded and with all members of the Liquor Licensing Authority present voting aye, THE MOTION CARRIED.

The third complaint was for Grivas, Corp. d/b/a Hart's Corner Bar & Restaurant, 5201 W. Mississippi Ave. for alleged sale to a minor.

Mr. Muniz made a motion to serve a notice of hearing and order to show cause why the Tavern License held by Grivas, Corp. d/b/a Hart's Corner Bar & Restaurant, 5201 W. Mississippi Ave., should not be suspended or revoked, such hearing to be held on March 22, 2007. The motion was seconded and with all members of the Liquor Licensing Authority present voting aye, THE MOTION CARRIED.

ITEM 7 - ADJOURNMENT

There being no further business to come before the Authority, Chairwoman Hansson adjourned the meeting at 7:26 p.m.
