A Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.
ITEM 1 - CALL TO ORDER
Chairwoman Hansson called the meeting to order at 7:00 p.m.

Full and timely notice of this meeting had been given and a quorum was present.
ITEM 3 - APPROVAL OF MINUTES

Mr. Williams made a motion to accept the meeting minutes of July 13, 2006 and
August 24, 2006. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.
ITEM 4 - NEW APPLICATION

d/b/a Hi Grade Liquor

Paul Miller, 11471 W. Hampden Place, Lakewood, CO 80227, was sworn in.
Patricia Miller, 11471 W. Hampden Place, Lakewood, Co 80227, was sworn in.
Susan Duffy Schwall, 415 Garwood Ct., Colorado Springs, CO 80911, was sworn in and stated her company, Liquor Licensing Professionals, LLC, did the survey for Hi Grade Liquors. Ms. Duffy Schwall stated the results of the survey.
There was a question and answer period between the Liquor Licensing Authority and Ms. Duffy Schwall.
Paul Miller stated he and Patricia Miller have been in business for almost 25 years. Mr. Miller stated the income from the liquor store will be retirement income for them. Mr. Miller stated they are conscious of the neighbors and don't want to be a burden on them. Mr. Miller stated it is a good opportunity for them and for the neighbors, as well.
There was a question and answer period between the Liquor Licensing Authority and Mr. Miller.
Patricia Miller stated that Mr. Miller, in the past, has had to work out of town and stated it is an opportunity for the two of them to work together.
Mr. Muniz moved to approve the application for a Retail Liquor License for K & S Rex, Inc. d/b/a Hi Grade Liquor, located at 1070 S. Union Blvd. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.
ITEM 5 - NEW APPLICATION

Happy Hour Liquors, LLC
d/b/a Happy Hour Liquors

Tina Nguyen, 305 S. Kipling, Unit F, Lakewood, CO, was sworn in.
Hoang Nguyen, 305 S. Kipling, Unit F, Lakewood, CO, was sworn in and stated that both he and Ms. Ngueyn did the petitioning. Mr. Nguyen stated there were 48 signatures and all were in favor of the liquor store. Mr. Nguyen stated their experience in the alcohol industry.
There was a question and answer period between the Liquor Licensing Authority and the applicants.
Mr. Wisneski moved to approve the application for a Retail Liquor License for Happy Hour Liquors, LLC d/b/a Happy Hour Liquors, located at 305 S. Kipling St. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.
ITEM 6 - NEW APPLICATION
Hotel & Restaurant License
Las Margaritas, Inc.
d/b/a Las Margaritas Restaurant & Cantina
6981 W. Alaska Dr.
Margarita Granados, 1307 Josephine St., Denver, Co 80206, was sworn in.
Duane Jeffrey Bowen, 4250 S. Yukon Way, Lakewood, CO 80235, was sworn in and stated he is the President of Las Margaritas, Inc. and Ms. Granados is Vice President. Mr. Bowen stated they have been in business with this company since the spring of 1991. They held a liquor license in the City and County of Denver until 2005. This new location in the Belmar District is replacing the Denver location. Mr. Bowen stated this would be a family restaurant featuring healthy Mexican cuisine. Mr. Bowen stated the hours they will be open and stated the training that all their employees will undergo. Mr. Bowen stated their policies on alcohol service.
Ms. Granados stated they would be creating approximately 40 new jobs. Ms. Granados stated that they will be serving alcohol outdoors but customers will be required to go inside the restaurant to be seated. Ms. Granados stated there will be a four foot railing around the two patios and will be supervised at all times. Ms. Granados stated there are plenty of windows overlooking the patios and there will be a lot of visibility from inside. Ms. Granados stated they have had a liquor license at the location in Denver for about 13 years and have never had a problem.
There was a question and answer period between the Liquor Authority and Ms. Granados.
Max Scott, 1216 Tiperary St., Boulder, CO 80306, was sworn in and stated he is the owner and operator of Oedipus, Inc. Mr. Scott stated his company did the survey for the petitions and stated the results of the survey, as well as the procedures for doing the petitions.
Mr. Muniz moved to approve the application for a Hotel & Restaurant License for Las Margaritas, Inc. d/b/a Las Margaritas Restaurant & Cantina, located at 6981 W. Alaska Dr. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.
ITEM 7 - NEW APPLICATION (Continued to October 12, 2006)

The applicants attorney had previously requested a continuance to October 12, 2006.
ITEM 8 - SHOW CAUSE HEARING (Continued from August 24, 2006)
Tavern License
Rocky Mountain Tacos, LLC
d/b/a El Taco Tote
6166 W. Alameda Ave.
Ms. Roth stated that the complaint was issued because El Taco Tote had not filed sales tax returns and they had provided insufficient checks to the City. Ms. Roth stated that since that time, the licensee for El Taco Tote has disappeared. Ms. Roth stated attorney Mike Feeley has represented the licensee and that she and Paul Kennebeck had been in contact with Mr. Feeley. Ms. Roth stated the landlord for the building retained attorney Bob Dill and that she and Mr. Kennebeck had been in contact with Mr. Dill. The licensee did not pay their taxes, they left the premises and the owner of the land and building came in and paid the taxes. Ms. Roth stated that she is now asking that the complaint be dismissed. Ms. Roth stated the owner got an eviction order against the business and will be taking over the liquor license by operation of law. Ms. Roth stated the owner will not be using the license and that they intend to transfer it to whomever leases the building. Ms. Roth stated they have talked to Mr. Feeley who indicated that the licensee of El Taco Tote does not have any objection to the fact that they do not have access to the premises or that the liquor license is being transferred to the landowner.
There was discussion among the members of the Liquor Licensing Authority.
Mr. Wisneski moved that in the matter of the suspension or revocation of the
Tavern License for Rocky Mountain Tacos, LLC d/b/a El Taco Tote, located at
6166 W. Alameda Ave. be dismissed based on the information provided by the City
Attorney. The motion was seconded. Vote: 5 Ayes 0 Nays. THE MOTION CARRIED.

There being no further business to come before the Authority, Chairwoman Hansson adjourned the meeting at 7:44 p.m.
