RESOLUTION: 2006-67

SUBJECT: A resolution designating the Jefferson County Department of Health and Environment as the governing body to coordinate meth lab cleanup activities in the City of Lakewood.

RECOMMENDATION: Approval

FUNDING SOURCE: N/A

SUMMARY AND BACKGROUND OF SUBJECT MATTER: On April 21, 2004, the governor signed HB 04-1182 mandating the cleanup of clandestine methamphetamine laboratories. The bill provides that a property owner who cleans up a property under the promulgated standards will have immunity from civil lawsuits from future owners, occupants and neighbors for alleged health based losses.

The bill also provides that a city council shall designate a "governing body" to effectuate the provisions of the bill relating to meth lab cleanup. The Jefferson County Department of Health and Environment is requesting the municipalities of Jefferson County designate the Jefferson County Department of Health and Environment as the governing body according to Colorado Revised Statute Title 25 Section 18.5 to efficiently enforce methamphetamine laboratory cleanup regulations.
