A RESOLUTION
SETTING A SPECIAL MUNICIPAL ELECTION FOR JANUARY 2, 2007, TO BE CONDUCTED AS A MAIL BALLOT ELECTION
WHEREAS, the Lakewood City Clerk's Office received a Referendum Petition regarding Ordinance O-2006-15 on September 8, 2006, which the City Clerk determined to contain the sufficient number of required registered electors' signatures; and,
WHEREAS, the City Council voted on October 9, 2006, not to repeal Ordinance O-2006-15; and,
WHEREAS, the City Council has decided it is in the best interest of the citizens of Lakewood to call for a Special Municipal Election to allow the registered electors of the City of Lakewood to vote on Ordinance O-2006-15.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, that:
SECTION 1. The City Council hereby sets a special municipal election for January 2, 2007, such election to be conducted as a mail ballot election.
SECTION 2. That the provisions of the Uniform Election Code (C.R.S. Title 1, Article 7.5, also known as the "Mail Ballot Election Act") pertaining to mail ballot elections for the conduct of the January 2, 2007 special municipal election are hereby adopted by the City Council for said election, except that, to the extent that any provisions of the Mail Ballot Election Act pertaining to the preservation of election records conflict with Title 31, Article 10 of the Colorado Revised Statutes (the "Municipal Election Code"), the provisions of the Municipal Election Code shall prevail.
SECTION 3. The City Council hereby directs the City Clerk to conduct the special
municipal election and to perform all duties and responsibilities relating to
such election.
SECTION 4. The ballot title for the question shall be as follows:
"An ordinance rezoning 21.764 acres of land located within Iron Spring
Park, City of Lakewood, further approving the exchange of such 21.764 acres
of City owned parkland, being a portion of Iron Spring Park, for 21.771 acres
of privately owned land, located south of Alameda Parkway and west of Hutchinsons
Green Mountain Village Filings 54, 55, 56 and 62, further, providing that the
land received by the City shall be used for open space and park purposes by
the City of Lakewood. "

SECTION 5. Effective Date. The provisions of this Resolution shall take effect
immediately upon its adoption.
INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council October 9, 2006, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
