SUBJECT: Acceptance of a deed for 5.607 acres of open space along Bear Creek on the east side of the Kohl's shopping center.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
As part of the agreements related to the development of the South Wadsworth
Retail Center (Kohl's) in 2003, the City agreed to accept the dedication of
the open space area behind the shopping center. Before the City would accept
the deed, the developer was required to obtain final approval and acceptance
of the improvements in the area from Urban Drainage and Flood Control District
and the United States Army Corps of Engineers, which required the vegetation
to mature. Both of these agencies have now accepted the improvements.
