A RESOLUTION

AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION (CDOT) FOR THE DESIGN, RIGHTS-OF-WAY ACQUISITION AND CONSTRUCTION OF INTERESECTION IMPROVEMENTS AT WEST COLFAX AVENUE AND KIPLING STREET

WHEREAS, the intersection of West Colfax Avenue and Kipling Street needs improvement to reduce congestion and improve safety; and

WHEREAS, improvement work required includes adding a double left turns to the northbound, eastbound and westbound approaches and adding acceleration lanes for north and southbound Kipling Street; and

WHEREAS, federal funds of $1,875,000 are available to complete the project with the City's contribution estimated at $1,875,000; and

WHEREAS, Lakewood administration of the project will be coordinated through CDOT and requires that the City enter into an intergovernmental agreement for the City to design, acquire necessary rights-of-way and construct the project.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, an agreement with the CDOT, in form approved by the City Attorney, for design, rights-of-way acquisition and construction of the project. The City of Lakewood's contribution shall not exceed One Million Eight Hundred Seventy-five Thousand and No/100 Dollars ($1,875,000) without additional City Council authorization.

SECTION 2. The City Treasurer is hereby authorized to make payment to the CDOT in accordance with said contract.

INTRODUCED, READ AND ADOPTED by a vote of ____ for and ____ against at a regular meeting of the City council on September 11, 2006, at 7 o'clock p.m. at Lakewood Civic Center South, 480 South Allison Parkway, Lakewood, Colorado.
