RESOLUTION: 2006-50

SUBJECT: A resolution providing notice to all peace officers of the duty to cooperate with state and federal officials in the enforcement of state and federal laws regarding immigration.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The proposed resolution complies with the requirements of Senate Bill 06-90, pertaining to Colorado Revised Statute, Title 29, Article 29, "Immigration Status - Cooperation with Federal Officials" which went into effect on May 1, 2006. This legislation requires that the local governing body of each local government pass a resolution that directs it peace officers to cooperate with state and federal officials with regards to enforcement of state and federal laws regarding immigration and further directs its peace officers to comply with the new provisions set forth in Senate Bill 06-90. The failure to do so will make the local government ineligible to receive local government financial assistance through grants administered by the Department of Local Affairs. The proposed resolution complies with the directives of Senate Bill 06-90.
