SUMMARY AND BACKGROUND OF SUBJECT MATTER: In 2005 the City of Lakewood and 14 other municipalities (Local Government Intervenors, LGI) intervened in a Public Utility Commission (PUC) hearing requested by the Public Service Company (PSCo) regarding quality of service matters. The PUC conducted a hearing March 6-10, 2006. Subsequent to that hearing, PSCo and the LGI entered into negotiations resulting in a partial stipulation and settlement agreement that is subject to the approval by the elected governing bodies of the respective municipalities. You have received a memorandum from Ken Fellman, the attorney representing the LGI and the proposed Partial Stipulation and Settlement Agreement. The Partial Stipulation and Settlement Agreement addresses topics such as performance measures relating to street lighting and traffic signal lighting services; relationship between the Agreement and existing Franchises and street lighting agreements; franchise issues such as the provision of information supporting the billing for non-routine street light maintenance, terms and conditions governing relocation of Company facilities in municipal rights of way, and requirements for reporting of information relating to street light outages and non-routine maintenance; billing for non-routine street light maintenance; billings for street light service: and reporting relating to third-party damage to Company facilities.
