RESOLUTION: 2006-47
SUBJECT: Building permits and related fees
RECOMMENDATION: The attached resolution is recommended for adoption.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
An Ordinance scheduled for City Council vote on September 11, 2006 will update building codes and includes provisions that require City Council adoption by resolution of building code related fees. The fees are proposed in this resolution.
The attached resolution reinstates current fees with no increases with one exception. The exception is the fee for temporary Certificates of Occupancy. Temporary Certificates of Occupancy are issued when work related to a building is incomplete, but the remaining work need not prevent occupancy of the building. Temporary Certificates of Occupancy are issued for a period of up to six months.
While temporary Certificates are appropriate at times, overuse can cause problems for property owners and consume additional staff resources to resolve. One issue that has become more frequent is the tendency for contractors not to contact the City after completing remaining work or not to complete necessary work. The property owner is then left without a Certificate of Occupancy when the temporary Certificate expires. The growing practice of mortgage companies to close on property sales with a temporary Certificates of Occupancy has increased the frequency of the problem. In those situations where contractors fail to complete remaining work, the City is faced with requiring the new owner to complete the work. The staff time consumed following-up on temporary Certificates could be better utilized providing good service on other construction projects.
The current fee for a temporary Certificate of Occupancy has been in place since 1980 and is $25 with fees of $50 and $100 for first and second renewals. It is proposed to increase the fee for an initial temporary Certificate of Occupancy to $750 of which $500 would be refunded if a final Certificate is issued prior to the temporary Certificate expiring. The fee for renewing a temporary Certificate is proposed to be $500. This approach has been used by Jefferson County since 2001 and has decreased the number of temporary Certificates requested.
