RESOLUTION: 2006-35

SUBJECT: Request for Jefferson County Open Space to participate in Tolen Acquisition

RECOMMENDATION: The Department of Community Resources recommends the approval of the resolution to acquire a portion of the Tolen Property with the assistance of the Jefferson County Open Space Program.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Department of Community Resources was approached by the Trust for Public Land (TPL) in early 2005 regarding any desire of the City to acquire the 7.1 acre Tolen Property. The Tolen Property is located between Kipling Street and Miller Street, and 10th Avenue and 12th Avenue. The property is immediately adjacent to Sunset Park along Lakewood Gulch. Portions of the property show in several planning documents as desirable additions for open space, park, and trail corridor.

Due to budgetary concerns, TPL was told that the City would not act on any potential acquisitions until after the 2005 election. With the affirmative outcome of the election, and saving from the re-financing of the COP projects, the Department gave positive indications to TPL that the City would be interested in the Tolen Property. There has also been considerable interest in this acquisition from the surrounding neighborhood. Two appraisals, a title commitment, a property survey, and a Phase 1 environmental review have been completed on the property. A price has been agreed upon pending Lakewood City Council and Jefferson County Open Space approval.

Per Lakewood City Council Resolution 2005-48, prior to the sales tax election, the five-year budget projection of maintenance and operation costs is approximately $25,000, or an estimated $5,000 annually. The Department anticipates only minimal maintenance costs due to the nature of this site. Once the property is acquired, a one-time expense estimated to be $35,000 to demolish some existing buildings on the site will be needed. The above expenses will be paid from Lakewood's Open Space Attributable Share, from the existing Urban Parks operations budget.
