A RESOLUTION

SETTING A SPECIAL MUNICIPAL ELECTION FOR JUNE 27, 2006, TO BE CONDUCTED AS A MAIL BALLOT ELECTION.

WHEREAS, registered electors in Lakewood submitted an initiative petition regarding a rezoning of property known as "Green Mountain Ravine"; and

WHEREAS, upon verification, the City Clerk has determined the initiative petition is sufficient, containing the requisite number of signatures to bring the item before the City Council; and

WHEREAS, the City Council may either adopt the initiated ordinance without alteration or submit it to the voters at a special election to be held not less than 30 nor more than 90 days from the date the petition was submitted to the City Council; and

WHEREAS, the City Council at it's regular meeting held May 8, 2006, voted not to adopt the initiated ordinance and has determined that the citizens of Lakewood should have the opportunity to vote on the initiated ordinance at a special municipal election; and

WHEREAS, the City Clerk has recommended that the special election be conducted as a mail ballot election on June 27, 2006.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, that:

SECTION 1. The City Council hereby sets a special municipal election for June 27, 2006, such election to be conducted as a mail ballot election.

SECTION 2. The City Council hereby directs the City Clerk to conduct the special municipal election and to perform all duties and responsibilities relating to such election.

SECTION 3. The ballot title for the citizen-initiated ballot question shall be: "Shall the City of Lakewood rezone the parcel of land known as Green Mountain Ravine from Planned Development (PD) to 2-R Single Family Residential?"

Section 1. Effective Date. The provisions of this Resolution shall take effect immediately upon its adoption.

INTRODUCED, READ AND ADOPTED by a vote of ____ for and ____ against at a regular meeting of the City Council on May 8, 2006, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
