SUBJECT: Ordinance Amendment OA-06-002

Amendment to the Zoning Ordinance to bring the vesting of property rights in conformance with state statutes by allowing property rights to be vested with land use applications other than a rezoning.

RECOMMENDATION: Staff recommends approval of these amendments to the Zoning Ordinance to allow vesting of property rights to be done at the time of a Site Specific Development Plan, and to define what land use applications that qualify as a "Site Specific Development Plan" in the City of Lakewood.

FUNDING SOURCE: N/A

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The proposed amendments to the Zoning Ordinance provide the City with more flexibility for granting vested property rights, comparable to those allowed under state statutes. The definition of a Site Specific Development Plan will be expanded to include land use applications other than a rezoning, such as Planned Developments and Development Agreements, while certain applications, such as variances or architectural plans, will be restricted from securing a vested property right. Staff has provided a staff report with analysis of the application for City Council use.
