ORDINANCE: O-2006-32
SUBJECT: Case OA-06-001, an amendment to Section 17-17-8 of the Lakewood Zoning Ordinance relating to procedures for the legislative rezoning of property.

RECOMMENDATION: APPROVAL of an amendment to Section 17-17-8 of the Zoning Ordinance. Planning Commission, by a vote of 7-0 at the November 1, 2006 meeting, recommend APPROVAL of this request to City Council.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: Section 17-17-8 of the Lakewood Zoning Ordinance currently allows for the initial legislative rezoning of properties. A Citywide legislative rezoning occurred in a Citywide re-mapping in 1980. The revised section 17-17-8 sets forth criteria for initiating legislative rezoning. These criteria include that:
1. the proposed rezoning affects a large number of properties and the proposed
rezoning is not limited only to a specific individual or readily identifiable
group of individuals; and,
2. it would be inefficient, cumbersome, and unduly burdensome on the resources
of the City to rezone the potentially affected properties in a quasi-judicial
manner on a site-by-site basis; and,
3. the rezoning is prospective in nature and reflects public policy of a permanent
or general character impacting the City on a scale greater than at the individual
property level; and,
4. the proposed rezoning is intended to:
a. implement specific goals or objectives of the City's Comprehensive Plan;
and/or,
b. rezone a large number of properties to a newly created zone district in a
manner consistent with the goals or objectives of the City's Comprehensive Plan.
