AN ORDINANCE
AUTHORIZING AN AGREEMENT TO PURCHASE APPROXIMATELY 65 ACRES OF THE DENVER FEDERAL CENTER FROM THE FEDERAL GOVERNMENT AND AUTHORIZING AGREEMENTS TO SELL SAID PROPERTY TO CATHOLIC HEALTH INITIATIVES COLORADO AND THE REGIONAL TRANSPORTATION DISTRICT AND FURTHER DECLARING AN EMERGENCY.
WHEREAS, the United States of America, acting through the General Services Administration, has declared as surplus approximately 65 acres of land in the western portion of the Denver Federal Center and has entered into negotiations to sell the property to the City of Lakewood or its approved designee; and,
WHEREAS, Catholic Health Initiatives Colorado, or its assigns, is interested in purchasing a portion of the surplus federal property for development of medical uses including replacement of St. Anthony Central Hospital; and,
WHEREAS, the Regional Transportation District is interested in purchasing a portion of the surplus federal property to develop a transit station to serve the West Corridor light rail line, replace the Cold Spring park-n-Ride, and provide transit-oriented development.
NOW, THEREFORE, BE IT ORDAINED by the City Council of Lakewood, Colorado, that:
SECTION 1. AGREEMENT TO PURCHASE. The City Manager is hereby authorized to execute and the City Clerk to attest an agreement, in form approved by the City Attorney, with the United States of America, acting through the General Services Administration, to purchase approximately 65 acres of land in the western portion of the Denver Federal Center.
SECTION 2. AGREEMENTS TO SELL. The City Manager is hereby authorized to execute and the City Clerk to attest agreements, in form approved by the City Attorney, to sell said property to Catholic Health Initiatives Colorado, or its assigns, and to the Regional Transportation District.
SECTION 3. EMERGENCY. The proposed annexation, purchase, sale, and development of property at the Denver Federal Center involves multiple parties whose objective is the annexation, development, and operation of substantial improvements in a time-sensitive manner. These improvements will have significant benefit to the community. In order to accomplish this objective in a timely manner, the authorization of the purchase and sale of the property for such development needs to be accomplished as quickly as possible.
SECTION 4. EFFECTIVE DATE. This Ordinance is necessary for the immediate preservation of the City of Lakewood's public peace, health, or safety and shall take effect upon the signature of the Mayor of the City of Lakewood.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 13th day of November, 2006; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org, on the 16th day of November, 2006; set for public hearing on the 27th day of November, 2006, read, finally passed and adopted by the City Council on the 27th day of November, 2006, and, signed and approved by the Mayor on the 28th day of November, 2006.
