SUBJECT: Case RZ-05-001

Proposal to rezone a property encompassing two lots, Lot 1 of Block 1, Park Forum Subdivision, and Lot 2 of Block 1, Terrace Point Subdivision Filing No.2 that are currently zoned Planned Development (PD) and under the provisions of Park Forum Two and The Forum East Official Development Plans (ODP) to a Planned Development Zone District with a conceptual site plan, as found in Article 18, to allow construction of a 51,680 square foot multi-tenant retail center. The lots will be required to be consolidated prior to approval of the Final Site Plan for the proposed development.

RECOMMENDATION: Staff recommends approval of this rezoning. Planning Commission, by a vote of 7-0 at the October 4, 2006 meeting, recommended APPROVAL of this request by City Council.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant is requesting to rezone approximately 5.63 acres of land from a Planned Development Zone District (PD) to a newly created PD, which permits retail land uses. A 51,680 square foot multi-tenant retail center would be constructed to compliment the recently constructed Kohl's Store to the north and provide more vibrancy to the shopping center area. The property is currently undeveloped.
