ORDINANCE: 2006-20
SUBJECT: Ordinance declaring the City's intent to acquire interests in real property for the Colfax Avenue (SH-40) at Simms Street improvement project.

RECOMMENDATION: Adoption of this ordinance.
FUNDING SOURCE: Federal Funds and Lakewood Capital Improvement Funds.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City will be improving the intersection at West Colfax Avenue and Simms Street by replacing the existing traffic signals with new traffic signals, provide double left turns lanes for northbound traffic on Simms Street and westbound traffic on West Colfax Avenue and constructing sidewalk improvements. These improvements will make the intersections safer for pedestrian and vehicular traffic.
Because this is a Federally funded project, the Colorado Department of Transportation (CDOT) requires the City to convey any property interests acquired in fee simple along a State Highway (West Colfax Avenue) to the Colorado Department of Transportation. This ordinance also authorizes the City to convey these property rights to CDOT.
Public Works has sent letters in January, 2006 and held a public meeting on July 13, 2006 to inform property owners of this project. The project is anticipated to start in 2007. In order to start construction of the improvements at the scheduled date, the City needs to start acquiring the necessary property interests.
