AN ORDINANCE

SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF LAKEWOOD AT THE SPECIAL MUNICIPAL ELECTION ON NOVEMBER 7, 2006, A BALLOT ISSUE FOR THE PURPOSE OF AUTHORIZING A VOTER-APPROVED REVENUE CHANGE FOR THE CITY OF LAKEWOOD.

WHEREAS, in order to ensure that the City of Lakewood may receive open space revenues and accept grants for parks, recreation and cultural opportunities, for public safety opportunities, and for street opportunities without violating the revenue limitations of the Taxpayers' Bill of Rights (TABOR); and

WHEREAS, the City Council desires to request the approval of the registered electors of the City of Lakewood to collect, retain and spend revenues received for open space and from grants for:
· Parks, recreation and cultural opportunities
· Public safety opportunities
· Street opportunities

NOW, THEREFORE, BE IT ORDAINED By The City Council Of The City Of Lakewood, Colorado, that:

SECTION 1. The following ballot issue be submitted to a vote of the registered electors of the City at the special municipal election on November 7, 2006:

CITY OF LAKEWOOD BALLOT ISSUE 2A

WITHOUT INCREASING ITS CURRENT TAX RATE OR ADDING ANY NEW TAXES, SHALL THE CITY OF LAKEWOOD, COLORADO BE AUTHORIZED TO COLLECT, RETAIN, AND SPEND OPEN SPACE REVENUES AND GRANTS FOR STREETS, PUBLIC SAFETY, PARKS, RECREATION AND CULTURAL OPPORTUNITIES RECEIVED BY THE CITY DURING THE YEAR 2007 AND ALL SUBSEQUENT YEARS THEREAFTER, NOTWITHSTANDING ANY REVENUE OR SPENDING LIMITATIONS IN ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION (TABOR)?

SECTION 2. The City Clerk shall take all actions necessary for such ballot issue to be presented to the registered electors of the City of Lakewood at the special municipal election on November 7, 2006.

SECTION 3. If the registered electors approve this measure, the City will collect, retain and spend revenues it collects as set forth in the ballot issue without imposing any new taxes or raising any existing taxes.

SECTION 4. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 14th day of August, 2006; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org, on the 17th day of August, 2006; set for public hearing on the 28th day of August, 2006, read, finally passed and adopted by the City Council on the 28th day of August, 2006, and, signed and approved by the Mayor on the 29th day of August, 2006.
