REQUEST FOR COUNCIL ACTION

ORDINANCE: Ordinance O-2006-17

SUBJECT: Adoption of building codes

Adoption of the 2006 International Building Code, 2006 International Residential Code, 2006 International Fire Code, 2006 International Plumbing Code, 2006 International Mechanical Code, 2006 International Fuel Gas Code, 2006 Energy Conservation Code and the 2005 National Electrical Code.

RECOMMENDATION: The attached ordinance is recommended for adoption.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

Every third year, building related codes are updated to reflect development of new methods of construction and new materials for construction. The development of the new codes allows jurisdictions, such as Lakewood, to stay current with the building industry while ensuring the safety of building occupants.

Staff has reviewed the new codes with the City of Lakewood Board of Appeals. By City Council Ordinance, the Board of Appeals is the body that is charged with making recommendations to the City Council regarding changes to the codes. The Board members are required to be "qualified by experience and training to pass upon matters pertaining to building construction." A memo from the Chairman of the Board of Appeals recommending adoption of the new codes is attached.

It is recommended that Lakewood update its codes in order to (1) keep current with the building industry, (2) enhance consistency among the jurisdictions with which builders work in the Denver area, and (3) ensure the safety of building occupants.

Addendum: On the fourth page from the end of this lengthy Ordinance, Section 12 modifies the size of the Board of Appeals (BOA) from 7 regular members and 4 alternates to 7 regular members only. This language is meant to make the role of a BOA member more meaningful. In the last 5 years, the BOA has met only 4 times and it is difficult for alternates, who cannot always vote, to maintain an interest in serving on the BOA.

Historically, this same condition existed on another City board, the Board of Adjustment. The Board of Adjustment was changed to 7 regular members in the early 1990's and has worked well since.

At this time the BOA has a total of only 7 members including all regular and alternate members and this would be a good time to make this change if Council approves.

The Public Works Director recognizes this aspect of the Ordinance should have been noted in the original Request for Council Action.
