AN ORDINANCE

TRANSFERRING RESERVE FUNDS FROM THE GENERAL FUND TO THE CAPITAL IMPROVEMENT FUND FOR PURPOSES OF FUNDING A CHANGE ORDER TO THE 2006 OVERLAY AND PATCHING PROGRAM, APPROVING A SUPPLEMENTAL BUDGET APPROPRIATION IN THE CAPITAL IMPROVEMENT FUND AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER; FURTHER DECLARING AN EMERGENCY

WHEREAS, Premier Paving Inc. is currently contracted to perform the 2006 Overlay and Patching Program (Bid No. 2579), in the amount of Five Million Seven Hundred Ninety Three Thousand Eight Hundred Seventy Six and 39/100 ($5,793,876.39) Dollars; and,

WHEREAS, the City desires to take advantage of favorable contract pricing to complete additional overlay work in 2006; and,

WHEREAS, the contract with Premier Paving Inc. allows for change orders of up to 25% of the original contract value, an amount of One Million Four Hundred Forty Eight Thousand Four Hundred Sixty Nine and 10/100 ($1,448,469) Dollars; and,

WHEREAS, pursuant to the Lakewood Home Rule Charter, Section 12.7, the City Council may authorize the transfer of any unencumbered appropriation balance, or portion thereof, between administrative departments or among funds; and,

WHEREAS, pursuant to the Lakewood Home Rule Charter, Section 12.8, the City Council may make supplemental appropriations by ordinance during the fiscal year.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. In accordance with Section 12.8 of the Lakewood Home Rule Charter, a supplemental budget appropriation is hereby authorized in the Capital Improvement Fund, whereby the Street Resurfacing Program budget will be increased for fiscal year 2006 by $1,448,469 utilizing funding from General Fund transfer.

SECTION 2. In accordance with Section 12.7 of the Lakewood Home Rule Charter, a transfer is hereby authorized for fiscal year 2006 in the amount of $1,448,469 from the General Fund to the Capital Improvement Fund.

SECTION 3. The City Manager is hereby authorized to execute a change order to the contract with Premier Paving Inc. in the amount of One Million Four Hundred Forty Eight Thousand Four Hundred Sixty Nine and 10/100 ($1,448,469) Dollars.

SECTION 4. The City Treasurer is hereby authorized to make payment to Premier Paving Inc. in accordance with the terms of said contract and change order.

SECTION 5. Emergency. This ordinance is necessary for the immediate preservation of the City of Lakewood's peace, health and safety. The immediate approval of the ordinance is necessary to allow the additional overlay work to be completed during the 2006 construction season.

SECTION 6. This ordinance shall take effect upon the Mayor's signature.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 24th day of July, 2006; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org, on the 27th day of July, 2006; set for public hearing on the 14th day of August, 2006, read, finally passed and adopted by the City Council on the 14th day of August, 2006, and, signed and approved by the Mayor on the 15th day of August, 2006.
