AN ORDINANCE

FOR THE ACCEPTANCE OF A PROPOSAL AND AUTHORIZING A CONTRACT FOR PROFESSIONAL URBAN PLANNING AND REAL ESTATE DEVELOPMENT SERVICES FOR THE WADSWORTH AND 13TH AVENUE STATION DEVELOPMENT AND IMPLEMENTATION PLAN; FURTHER APPROPRIATING FUNDS TO PAY FOR SAID SERVICES: FURTHER DECLARING AN EMERGENCY.

WHEREAS, The City Of Lakewood put forward a Request for Proposals (RFP) for Professional Urban Planning and Real Estate Development Services, RFP No. 2605, for the 'Wadsworth & 13th Avenue Station Development and Implementation Plan'; and

WHEREAS, Eight professional planning and real estate firms and or consultant teams submitted proposals; and

WHEREAS, Three professional planning and real estate firms and or consultant teams were interviewed by the selection team that included City of Lakewood staff, RTD staff and representatives from the private planning and design sector and the Lakewood business sector; and

WHEREAS, EDAW, Inc. was selected by the team to develop the "Wadsworth & 13th Avenue Station Development and Implementation Plan".

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The proposal of EDAW, Inc. for professional urban planning and real estate development services is hereby accepted.

SECTION 2. The City Manager is hereby authorized to execute, and the City Clerk to attest, a contract and any necessary change orders with EDAW, Inc. in form approved by the City Attorney in an amount not to exceed one hundred and fifty thousand dollars ($150,000).

SECTION 3. There is hereby appropriated from the Economic Development Fund, pursuant to Section 12.8 of the Home Rule Charter, the sum of one hundred and fifty thousand dollars ($150,000) to pay for the services provided in said contract.

SECTION 4. The City Treasurer is hereby authorized to make payments to EDAW, Inc., in accordance with the terms of said contract.

SECTION 5. This Ordinance is necessary for the immediate preservation of the public peace, health, or safety of the City Of Lakewood due to the fact the services authorized by this contract are time sensitive and must commence as soon as possible.

SECTION 6. This ordinance shall take effect upon the Mayor's signature.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 8th day of May, 2006; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org, on the 11th day of May, 2006; set for public hearing on the 22nd day of May, 2006, read, finally passed and adopted by the City Council on the 22nd day of May, 2006, and, signed and approved by the Mayor on the 23rd day of May, 2006.
