RFCA 2006-9 REQUEST FOR COUNCIL ACTION

ORDINANCE: O-2006-9

SUBJECT: Ordinance correcting the error in the legal description of Ordinance O-2005-38 vacating a portion of West Dartmouth Place adjacent to Bear Creek High School located at 3490 South Kipling Street, City of Lakewood, County of Jefferson, State of Colorado further declaring an emergency.

ADDRESS: 3490 South Kipling Street.

RECOMMENDATION: Adoption of the attached ordinance.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: City Council passed Ordinance O-2005-38 on December 12, 2005 vacating a portion of West Dartmouth Place because Jefferson County R-1 School District is in the process of relocating Bear Creek Elementary School to a location North of Bear Creek High School. As part of this school relocation a portion of West Dartmouth Place will be relocated further to the South. The surveyor that generated the legal description made an error that needs to be corrected. This new ordinance will correct the error in the legal description in Ordinance O-2005-38. City staff has reviewed the revised legal description and recommends this ordinance be approved.
