AN ORDINANCE

AMENDING CHAPTER 13.14 OF THE LAKEWOOD MUNICIPAL CODE RELATING TO STORMWATER QUALITY.

WHEREAS, the City of Lakewood has adopted Chapter 13.14 of the Lakewood Municipal Code relating to stormwater quality; and,

WHEREAS, the United States Environmental Protection Agency requires that certain City policies and definitions relating to stormwater quality and to the City's Stormwater Discharge Permit be adopted in its codes and regulations; and,

WHEREAS, it is necessary to clarify the meaning of the term "significant" as it relates to the City's Stormwater Discharge Permit.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Chapter 13.14 of the Lakewood Municipal Code is hereby amended by the addition of a new subsection 13.14.100 to be as follows:

13.14.100 Stormwater Discharge Permit

The term "significant" as it relates to the City's Stormwater Discharge Permit requirements for development and redevelopment is defined as:

(A) Sites that disturb an area of one (1) acre or more.

(B) Sites that disturb less than one (1) acre of total land area that are part of a larger common plan of development or sale, if the larger common plan will ultimately disturb one (1) acre or more.

SECTION 2. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 27th day of March, 2006; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org, on the 30th day of March, 2006; set for public hearing on the 10th day of April, 2006; read, finally passed and adopted by the City Council on the day 10th of , April 2006, and, signed and approved by the Mayor on the 11th day of April, 2006.
