AN ORDINANCE
AUTHORIZING AN EASEMENT TO PUBLIC SERVICE COMPANY FOR AN UNDERGROUND UTILITY LINE AND RELATED FACILITIES FOR A FEEDER LINE LOCATED IN THE GREEN MOUNTAIN RECREATION CENTER LOCATED AT 13198 WEST GREEN MOUNTAIN DRIVE, LAKEWOOD, COLORADO, FURTHER DECLARING AN EMERGENCY.
WHEREAS, Public Service Company has requested that the City of Lakewood convey to Public Service Company an easement for an underground feeder utility line and related appurtenances to provide better electric service to the Lakewood residence across land owned by the City; and
WHEREAS, the Charter of the City of Lakewood provides, in Section 14.3 thereof, that utility easements may be granted across property held for open space or parks purposes, which the City is willing to do.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The City Manager is hereby authorized to execute and the City Clerk
to attest an Easement and Right-of-way Agreement, in form approved by the City
Attorney, to Public Service Company across the land described in Exhibit "A"
attached hereto and made a part hereof, for underground utility line and related
appurtenances.
SECTION 2. Emergency. This ordinance is necessary for the immediate preservation
of the City of Lakewood's peace, health and safety. This is to expedite the
installation of the new feeder line to alleviate the power outages to the residence
of Lakewood that are occurring more frequently.
SECTION 3. This ordinance shall take effect upon the Mayor's signature.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 13th day of February, 2006; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org, on the 16th day of February, 2006; set for public hearing on the 27th day of February, 2006; read, finally passed and adopted by the City Council on the 27th day of February, 2006, and, signed and approved by the Mayor on the 28th day of February, 2006.

Exhibit "A"
An easement 10 feet in width situated in the Northeast Quarter of Section 19, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado and lying within Lot 2, Block 1, GREEN MOUNTAIN ACTIVITY CENTER, the plat of which is recorded in Plat Book 97, at Page 10, of the records of the Jefferson County Clerk and Recorder and being 5.00 feet on each side of the following described centerline:
Commencing at the Southeast corner of said Lot 2; thence N 00º20'09" W along the East line of said Lot 2, (assumed bearing all other bearings hereafter related thereto), a distance of 5.00 feet to the True Point of Beginning of the herein described centerline; thence leaving said East line S 89º39'51" W, parallel with the South line of said Lot 2, a distance of 528.52 feet; thence N 00º20'09" W, a distance of 250.00 feet; thence N 13º17'38" W, a distance of 126.45 feet; thence N 54º27'19" W, a distance of 105.00 feet, more or less, to a point on a northwesterly line of said Lot 2, said last point being the Point of Terminus of the herein described centerline.
