Subject: West Corridor Light Rail Study Session update

For the past several months the City of Lakewood and RTD have been negotiating an Intergovernmental Agreement (IGA) that specifies how the City of Lakewood will meet the local match obligation for the project.

A resolution authorizing the City of Lakewood to sign the final IGA will be placed on the December 11, 2006 council agenda. Based on a total project cost estimate of $511.8 million, the total local agency contribution is $12.8 million (2.5%). RTD, the City of Lakewood, Golden, Jefferson County and the City and County of Denver have agreed that $4.4 million of this obligation will be credited for South Platte drainage improvements that reduce RTD's bridge construction cost and remove the LRT tracks from the 100 year flood plain. This credit will be taken "off the top", leaving a total match of $8.4 million.

It has been further agreed among the City of Lakewood, Golden, Jefferson County and the City and County of Denver that the Lakewood's share of the remaining $8.4 million will be 45% or $3.78 million. Lakewood will meet this obligation by relocating a sewer line in 13th Ave., making drainage improvements in Richey Park and waiving permit fees while being credited with staff time to review plans, inspect construction, perform signal work and other similar items. The IGA will not be signed until Denver and RTD sign their IGA that commits Denver to the $4.4 million for the South Platte drainage improvements. A copy of the draft IGA is attached.

Other items to be discussed with council are:

· Potential of the City of Lakewood being a co petitioner with RTD should eminent domain proceedings be necessary to acquire property that will become the Lakewood's upon completion of the project.

· Modification of the adopted Street Closure Policy to specifically address all street
closures associated with the West Corridor Project.

· Street lighting along 13th Ave., both type and intensity.

· Future IGA with RTD to resolve all property rights questions in the 13th Ave. corridor.

· Future Operations and Maintenance IGA prior to opening of the line.

Alternative formats of this document available upon request.

The negotiation of the IGA between Lakewood and RTD has been a give and take process lasting several months. The end product is a document that is fair and reasonable for both RTD and the City.
