RESOLUTION: LRA 2006-4

SUBJECT: A resolution authorizing the Secretary/Executive Director of the Lakewood Reinvestment Authority (LRA) to enter into an Intergovernmental Agreement with the West Metro Fire District

RECOMMENDATION: Approval

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The West Colfax Avenue Corridor Reinvestment Plan, which was adopted by the Lakewood City Council on December 12, 2005, states that the Lakewood Reinvestment Authority (LRA) shall enter into an agreement with the West Metro Fire District (WMFD). The intergovernmental agreement will allow for the LRA to backfill tax increment garnered for redevelopment activities within the West Colfax Avenue Corridor Reinvestment Area to the WMFD and will allow the WMFD to waive that receipt of those funds to the extent that any redevelopment project within the West Colfax Avenue Corridor Reinvestment Area constructs facilities for the benefit of West Metro or mitigate the demand for fire protection and other emergency services. The attached resolution authorizes the Secretary/Executive Director to sign the agreement when finalized.

A RESOLUTION

A RESOLUTION AUTHORIZING THE SECRETARY/EXECUTIVE DIRECTOR OF THE LAKEWOOD REINVESTMENT AUTHORITY TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE WEST METRO FIRE DISTRICT

WHEREAS, the City Council of the City of Lakewood adopted the West Colfax Avenue Corridor Reinvestment Plan on December 12, 2005; and

WHEREAS, the West Colfax Avenue Corridor Reinvestment Plan states that the Lakewood Reinvestment Authority (LRA) shall enter into an Intergovernmental Agreement with the West Metro Fire Protection District to ensure that the West Metro Fire Protection District will receive portions of any property tax increment necessary to insure adequate fire protection services within the West Colfax Avenue Corridor Reinvestment Area; and

WHEREAS, the Intergovernmental Agreement provides that the parties shall adjust the amounts paid to the West Metro Fire Protection District to reflect facilities which may be constructed by the LRA for the use of the West Metro Fire Protection District as a part of any urban renewal project and to reflect any reduction in demands for fire protection services resulting from activities of the LRA; and

WHEREAS, the Lakewood Reinvestment Authority and the West Metro Fire District have drafted an intergovernmental agreement that complies with the intent of as stated in the West Colfax Avenue Corridor Reinvestment Plan.

NOW THEREFORE be it resolved that:

SECTION 1: The Executive Director of the LRA shall be authorized to sign the Intergovernmental Agreement with the West Metro Fire District in a form substantially similar to Exhibit A attached hereto, at such a time as the agreement has been approved by the Board of Directors of the West Metro Fire Protection District.
