A RESOLUTION
FOR APPROVAL OF THE WEST COLFAX AVENUE CORRIDOR REINVESTMENT PLAN AND FINDING THAT THE WEST COLFAX AVENUE CORRIDOR REINVESTMENT AREA IS A BLIGHTED AREA, DESIGNATING SUCH AREA AS APPROPRIATE FOR AN URBAN RENEWAL PROJECT PURSUANT TO THE URBAN RENEWAL PLAN, AND FINDING THAT THE ACQUISITION, CLEARANCE, REHABILITATION, CONSERVATION, DEVELOPMENT, REDEVELOPMENT OR A COMBINATION THEREOF OF SUCH AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY, MORALS, AND WELFARE OF THE CITIZENS OF THE CITY OF LAKEWOOD
WHEREAS, an urban renewal plan for the West Colfax Avenue Corridor Reinvestment Area has been submitted to the City Council of the City of Lakewood for appropriate action pursuant to Part 1 of Article 25 of Title 31, C.R.S.; and
WHEREAS, the West Colfax Avenue Corridor Reinvestment Area which is subject to the West Colfax Avenue Corridor Reinvestment Plan is described in Exhibit A to this Resolution; and
WHEREAS, the City of Lakewood Planning Commission adopted the Lakewood Comprehensive Plan on May 12, 2003; and
WHEREAS, the City of Lakewood City Council approved the Lakewood Comprehensive Plan on February 9, 2003, which is the general plan for the development of the City of Lakewood; and
WHEREAS, the City of Lakewood Planning Commission has adopted the West Colfax Avenue Action Plan as an amendment to the Lakewood Comprehensive Plan; and
WHEREAS, the West Colfax Avenue Corridor Reinvestment Plan has previously been submitted to the Lakewood Planning Commission for its review and recommendations as to conformity with the Lakewood Comprehensive Plan pursuant to C.R.S. §31-25-107(2); and
WHEREAS, the Lakewood Planning Commission has determined that the West Colfax Avenue Corridor Reinvestment Plan does conform to the Lakewood Comprehensive Plan; and
WHEREAS, no property in the West Colfax Avenue Corridor Reinvestment Area
has been included in an urban renewal plan previously submitted to the City
Council of the City of Lakewood; and
WHEREAS, the City Clerk of the City Lakewood has published the notice of the
time, place, and purpose of the public hearing to consider the adoption of
the West Colfax Avenue Corridor Reinvestment Plan in the Rocky Mountain News
in conformance with C.R.S. §31-25-107(3); and
WHEREAS, the City Clerk of the City Lakewood has provided written notice of the public hearing to consider the adoption of the West Colfax Avenue Corridor Reinvestment Plan to all property owners, residents, and business owners within the proposed West Colfax Avenue Corridor Reinvestment Area at their last known addresses in conformance with C.R.S. §31-25-107(4)(c); and
WHEREAS, the Jefferson County Commissioners have received notification of and copies of the West Colfax Avenue Corridor Reinvestment Plan as well as such additional information as is required by C.R.S. §31-25-107(3.5); and
WHEREAS, the West Metro Fire District has received notification of and copies of the West Colfax Avenue Reinvestment Urban Renewal Plan and has been given an opportunity to participate in an advisory capacity; and
WHEREAS, the Jefferson County School District has received notification of and copies of the West Colfax Avenue Reinvestment Urban Renewal Plan; and
WHEREAS, the City Council of the City of Lakewood has considered the Colfax Reinvestment Conditions Survey prepared by Matrix Design Group and the proposed West Colfax Avenue Corridor Reinvestment Plan; and
WHEREAS, City Council of the City of Lakewood has conducted a public hearing and considered the public testimony received.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood that:
1. Blight, as defined by C.R.S. §31-25-103(2), is present in the West
Colfax Avenue Corridor Reinvestment Area as documented by the Colfax Reinvestment
Conditions Survey prepared by Matrix Design Group and based on evidence presented
at the public hearing. The following blight factors are present in the West
Colfax Avenue Corridor Reinvestment Area: slum, deteriorated or deteriorating
structures; predominance of defective or inadequate street layout; faulty
lot layout; unsanitary or unsafe conditions; deterioration of site or other
improvements; unusual topography; unsafe or unhealthy buildings; environmental
contamination; existence of factors requiring high levels of municipal services
and substantial underutilization or vacancy of site, buildings or improvements;
and inadequate public improvements or utilities.
2. The West Colfax Avenue Corridor Reinvestment Area is a blighted area and
is appropriate for one or more urban renewal projects pursuant to Part 1 of
Article 25 of Title 31, C.R.S.
3. The boundaries of the West Colfax Avenue Corridor Reinvestment Area have
been drawn as narrowly as feasible to accomplish the planning and development
objectives for the West Colfax Avenue Reinvestment Area.
4. The West Colfax Avenue Corridor Reinvestment Urban Renewal Area does not
consist of an area of open land.
5. The West Colfax Avenue Corridor Reinvestment Plan conforms to the Lakewood
Comprehensive Land Use Plan, which is the general plan for the development
of the City of Lakewood.
6. The West Colfax Avenue Corridor Reinvestment Plan is hereby approved.
7. There exist feasible methods for the relocation of individuals and families
and business concerns in accommodations or areas suitable for their relocation.
8. The West Colfax Corridor Avenue Reinvestment Plan will afford maximum opportunity,
consistent with the sound needs of the City of Lakewood as a whole, for the
rehabilitation or redevelopment of the West Colfax Avenue Corridor Reinvestment
Area by private enterprise.
9. No additional county infrastructure or services will be required to serve
development currently contemplated within the West Colfax Avenue Corridor
Reinvestment Area. In the event development as a result of projects undertaken
in furtherance of this West Colfax Corridor Avenue Reinvestment Plan occurs
that requires additional county infrastructure or services, the Lakewood Reinvestment
Authority will promptly advise Jefferson County of such development and the
Lakewood Reinvestment Authority and the City of Lakewood will adequately finance
any additional county infrastructure or services required to serve such development.
10. The West Colfax Corridor Avenue Reinvestment Plan has met all currently
applicable requirements of C.R.S. § 31-25-105.5(2) and the principal
purpose for the adoption of the West Colfax Corridor Avenue Reinvestment Plan
is to facilitate redevelopment in order to eliminate or prevent the spread
of physically blighted or slum areas.
11. The acquisition, clearance, rehabilitation, conservation, development
or redevelopment or a combination thereof of the West Colfax Avenue Corridor
Reinvestment Area pursuant to the West Colfax Avenue Corridor Reinvestment
Plan is necessary in the best interests of the public health, safety, morals,
and welfare of the citizens of the City of Lakewood.
INTRODUCED, READ AND ADOPTED by a vote of 8 for and 3 against at a regular
meeting of the City Council December 12, 2005, at 7 o'clock p.m. at Lakewood
Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
