A RESOLUTION

AUTHORIZING THE AMENDMENT OF THE CITY OF LAKEWOOD DEFERRED COMPENSATION PLAN AND TRUST AGREEMENT

WHEREAS, the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA) requires certain amendments to the City of Lakewood Deferred Compensation Plan and Trust Agreement; and

WHEREAS, final regulations under Internal Revenue Code § 457, in accordance with EGTRAA, were issued on June 11, 2003; and

WHEREAS, the City of Lakewood Deferred Compensation Plan Board has recommended to the City Council amendments to the Plan Document and Trust Agreement.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City of Lakewood Deferred Compensation Plan and Trust Agreement be amended to comply with provisions of the Economic Growth and Tax Relief Reconciliation Act of 2001 as set forth in Exhibit A which is attached hereto.

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on November 28, 2005, at 7 o'clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
