A RESOLUTION

APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF WHEAT RIDGE FOR THE OVERLAY OF WEST 32ND AVENUE, FROM SIMMS STREET TO MORNINGSIDE DRIVE

WHEREAS, West 32ND Avenue from Simms Street to Morningside Drive is in need of an asphalt overlay, and is within the boundaries of the City of Lakewood and the City of Wheat Ridge; and

WHEREAS, the City of Wheat Ridge has bid a project to overlay West 32nd Avenue from Simms Street to Morningside Drive; and

WHEREAS, the project specifications and bid prices received for the overlay are acceptable, and the City of Lakewood share of the project cost is estimated to be $98,165.38; and

WHEREAS, the City of Lakewood and the City of Wheat Ridge would like to proceed with the overlay of West 32nd Avenue, from Simms Street to Morningside Drive

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute and the City Clerk to attest to an intergovernmental agreement with the City of Wheat Ridge for overlay of West 32nd Avenue, from Simms Street to Morningside Drive, in form approved by the City Attorney. The total contract amount shall not exceed ninety eight thousand, one hundred sixty-five and 38/100 dollars ($98,165.38)

SECTION 2. The City Treasurer is hereby authorized to make payment to the City of Wheat Ridge in accordance with the terms of said agreement.

INTRODUCED, READ AND ADOPTED by a vote of 10 for and 0 against at a regular meeting of the City Council on May 23, 2005, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
